Contract for Rental of a SMHA Property
Herein details a legal and binding contract between SMH Inc. and ______________________ the legal owner of __________________________, (hereinafter referred to as “the property owner”), a property within the SMHA.
This contract recognizes the following agreements between SMHA and the property owner. Section 23 of the SMHA CC&Rs stipulates that no property within the association shall be used for commercial purposes including, but not exclusive to, the renting of said property for more than 30 days within a calendar year unless the board of directors of the association relieves an owner of such provision upon the showing of hardship or necessity.
This document recognizes that it has been agreed upon by the board of directors that the above mentioned property owner has met said requirements and the board hereto relieves them of the aforementioned provisions upon agreement by the owner to the following stipulations
That the “commercial purposes” waver shall be for a maximum period of one year at which time the board of directors shall review the agreement. That the property owner provides the tenant(s) with a copy of the associations CC&R’s and that said CC&Rs shall be made a part of the lease agreement between the property owner and said tenant(s). That the board will be provided with a signed copy of the said lease agreement. The property owner agrees that, upon notice from the board that the tenant(s) is not complying with said CC&Rs, the owner will take appropriate action including proceeding with eviction processes if the board deems it necessary. That any and all costs incurred due to eviction proceedings shall rest fully with the property owner. That, upon refusal by the property owner to meet any of the above stipulations, the board reserves the right to proceed with eviction procedures itself and that all costs and expenses incurred by the board for said procedures shall be the full and sole responsibility of the property owner.
