TEMPORARY FINANCIAL HARDSHIP RENTAL WAIVER
Herein details a legal and binding contract between SAUNDERS MEADOW, INC., a California corporation with a mailing address at P.O. Box 390, Idyllwild, CA 92549 (hereinafter “SMI”) and ______________________ the legal owner of __________________________ (hereinafter “Property Owner”) a property within the Saunders Meadows Homeowner’s Association (hereinafter “SMHA”). This contract recognizes the following agreements between SMHA and Property Owner.
Section 23 of the SMHA CC&Rs stipulates that no property within the association shall be used for commercial purposes including, but not exclusive to, the renting of said property for more than 30 days within a calendar year unless the board of directors of the association relieves an owner of such provision upon the showing of hardship or necessity.
The board of directors of SMHA (hereinafter “The Board”) agrees that Property Owner has met said requirements and The Board hereto relieves Property Owner of the aforementioned provisions upon agreement by Property Owner to the following:
- The financial hardship rental waiver shall be for a period of one (1) year from the date a tenant begins tenancy (i.e., Property Owner may enter into a rental agreement with a tenant for a maximum duration of one (1) year). Although the rental waiver shall expire after one (1) year of tenancy, nothing in this agreement shall prohibit Property Owner from requesting another waiver from The Board should financial hardship conditions continue.
- Property Owner shall provide the tenant(s) with a copy of the SMHA CC&R’s and make the SMHA CC&Rs part of the tenancy agreement between the Property Owner and said tenant(s).
- Property Owner shall provide The Board with a signed copy of the tenancy agreement.
- Property Owner agrees that, upon notice from The Board that the tenant(s) is/are not complying with the SMHA CC&Rs, Property Owner will take appropriate action, including, but not limited to, proceeding with eviction processes if The Board deems it necessary.
- That any and all costs incurred due to compliance and/or eviction proceedings shall rest fully with Property Owner.
- Should Property Owner fail to meet any of the above stipulations, Property Owner agrees that The Board shall have the right to proceed with compliance and/or eviction procedures on behalf of SMI and that all costs and expenses incurred by SMI for said procedures shall be the full and sole responsibility of Property Owner.
The parties agree that this agreement constitutes the sole agreement between the parties and that if any part of this agreement is unenforceable then that portion shall be deemed removed and the remainder of this agreement shall remain in full force and effect.
